How to Register a Trademark in Vietnam: Cost and Process
A trademark must be distinctive and not conflict with an existing registration. Once granted, protection runs 10 years from the filing date and can be renewed indefinitely, each renewal for another 10 years. RedTab's execution fee benchmark is $190 – $400.
Vietnam Is First-to-File
Vietnam registers trademarks on a first-to-file basis — the eligibility test is about the mark itself (distinctive, non-conflicting), not about who used it first. This covers a first-time domestic filing; step-by-step procedure varies by mark type and applicant type, so RedTab confirms the exact filing steps as part of a case review rather than a generic checklist.
Eligibility
Vietnamese law sets two core conditions for a registrable trademark.
- Uniqueness: the trademark must be distinctive enough to distinguish the applicant's goods or services from others on the market.
- Non-infringement: the mark must not be identical or confusingly similar to a trademark already registered.
Documents Required
A complete application must include the following components on the date of submission.
- Completed form M1, per the applicant’s request.
- Two sample copies of the trademark, printed in black and white.
- Two sample copies of the trademark, printed in color (if the mark is colored).
- Payment of the prescribed fees.
- Power of attorney, if someone other than the applicant submits the application (professional representatives excepted).
